Objectives
Individual is an Assistant Prosecuting Attorney, responsible for prosecution of criminal offenses occurring within Delaware County. The Assistant Prosecuting Attorney's primary responsibility is to handle cases after an indictment is returned by the grand jury. This includes handling pretrial motions and negotiations, trial, and post-conviction matters including appeals. They will also be responsible for reviewing/presenting cases for Grand Jury. Assistant Prosecuting Attorneys represent the Prosecuting Attorney and the State of Ohio in court, in the community, to law enforcement, to victims, to witnesses, and to the general public.
Job Standards
Juris Doctor (JD)
Admitted to the practice of law in the State of Ohio.
Must possess a valid State of Ohio Driver's License and have an acceptable driving record.
Essential Functions
In a timely manner, assesses incoming adult felony cases for potential further prosecution, for referral to municipal court or for closing, then prepares the case file accordingly
Reviews cases indicted by the Grand Jury for additional investigation that may be needed and witnesses necessary for trial and motion hearings
Advises law enforcement agencies as to additional investigation that may necessary for successful prosecution of assigned cases
Meets and interacts with the victims and witnesses of criminal offenses to prepare them for potential court appearances
Appears in common pleas court for arraignments, pretrial hearings, trials, sentencings, post-conviction proceedings on assigned cases
Writes appellate briefs and prosecutes appeals on behalf of the Delaware County Prosecutor and the State of Ohio
Responds to all motions filed and files any appropriate motions necessary for the prosecution of assigned cases
Appears in court for all post-conviction proceedings including, but not limited to, community control sanction hearings, post conviction relief hearings, judicial release hearings, and appeals
Handles overflow matters as assigned for the Child Support Enforcement Agency
Maintains Twenty-Four-Hour availability to handle questions from Delaware County law enforcement agencies when on-call
Advises the Prosecuting Attorney on legal matters pertaining to the office
Assists other Assistant County Prosecutors as needed in the preparation and presentation of criminal cases
Other duties as assigned by the Prosecuting Attorney
