Associate Attorney - 1

Charlotte, NC 28204

Candidate can be located anywhere in the state of NC. We do not have an office in NC so attorney will work remotely with occasional travel to our Columbia, SC office.

The Attorney is licensed in North Carolina responsible for overseeing all legal aspects for cases. Attorney will work remotely or from our South Carolina office. Some travel is required.

Duties & Responsibilities:

Manage assigned portfolio of client cases

Draft the foreclosure complaint/notice of hearing, motions and orders for default, decree of foreclosure, notice of sale and trustees' deed or sheriff's deed after sale.

Research and analyze statutes, judicial decisions, legal articles, codes and the like.

Communicate with clients, internal staff and others to ensure case is handled appropriately.

Input and maintain information into case management system and ensure data integrity.

Attend hearings, settlement conferences and other appearances as necessary.

Establish a strong follow-up system to ensure deadlines are not missed for which various pleadings must be served and filed.

Prioritize and work at a fast pace on a high volume of files, with a great attention to detail.

Travel to court and clients, as necessary.

Other duties as assigned.

Qualifications

J.D from an ABA accredited law school

Bar Admission active and in good standing in North Carolina.

Licenses in additional states will receive favorable consideration.

Must have 8 or more years of experience.

Foreclosure experience with lenders and mortgage services in the state of practice, preferred.

Creditor’s Rights Bankruptcy experience a plus

Litigation skills

Experience in various client systems used in default services, such as LPS, Lenstar, and TEMPO a plus.

Previous experience with electronic case management systems preferred.

Geographic location within commuting distance to Columbia, SC as well as Charlotte, NC as necessary.

Knowledge of laws related to practice areas, legal codes and court procedures.

Outstanding written and oral communication skills to communicate with other attorneys, staff and clients.

Responsible for default litigation and attorney oversight for two or more state jurisdictions to ensure necessary legal services are effectively delivered. Establishes regional priorities and objectives.

Oversight: Case Management, Client Service and Compliance

Provides litigation oversight, including new case evaluations, ongoing reviews, case assignments, internal quality audits, trial strategies and final review of all cases designated for trial.

Ensures proper management of cases including appropriate documentation and billing. Serves as co-counsel with other legal staff and/or outside counsel on litigation, as needed.

Utilizes on-line and other references to research and analyze statutes, judicial decisions, legal articles, codes and the like.

Advises Management, Managing Attorneys and others about relevant changes, including impact analysis, recommendations for change and change implementation.

Ensures coverage for attendance at hearings, settlement conferences and other appearances as necessary.

Recommends and drives continuous improvement for client service.

Provides internal and external training as required for effective client service and business growth.

Reviews case management system reports to ensure integrity standards are achieved and upheld.

Supervision of Associates

Collaborates with direct reports in developing objectives and other standards; provides mentoring and guidance to state attorneys and associates.

Holds direct reports accountable for high levels of client service, including timely response, good scorecards, and effective representation of client interests consistent with client requirements across all lines of business.

Formally evaluates direct reports annually; provides formal and informal feedback on-going and as needed.

Recommends compensation changes.

Fosters a supportive work environment.

Keeps current on relevant laws, regulations, statutes, industry standards and client expectations.

Experience managing other attorneys is preferred.

Experience in various client systems used in default services, such as LPS, Lenstar, and Vendorscape, preferred.

Ability to effectively communicate and collaborate with Sr. Leadership

Outstanding written and oral communication skills to communicate with other attorneys, staff and clients.

Outstanding organizational skills.

Ability to handle a large volume of cases

Proficient in Microsoft Office products, such as Outlook and Word

4. At least 8 years of real estate and secure transaction

5. Experience managing other attorneys is preferred.

6. Experience in various client systems used in default services, such as LPS, Lenstar, and Vendorscape, preferred.

7. Attorney must have NC license active and in good standing for 8 or more years (per industry guidelines)

8. Experience in the default service industry. To understand the Foreclosure and Bankruptcy processes in judicial and non-judicial states.

9. Experience working in a creditor’s rights firm is a plus.

10. Proficient in Microsoft Office products, such as Outlook and Word
